Frequently you state that this law or that law is required to achieve some obvious and vital public good. Frequently this linkage is tenuous at inception, dubious in the compromise that is passed, and ignored in the implementation.

Therefore, I propose that all laws shall be challengeable in the courts and are subject to being stuck if it can be proven that they do not contribute to their stated aim. If by a preponderance of the evidence it can be shown that the Internet Child Safety Through Taking My Freedoms (ICSTTMF) Act of 2006 does not make or contribute to the making of Child Safety on the Internet, then bam!, it goes.

This will require a change in the legislative process, yes. It will require authors to more accurately (and honestly) write purposes to legislation and courts to determine how to judge those purposes and their achivement, yes. But the great public good that will come of it is clear.

However, it will make it more difficult to crooks to steal and liars to lie, so I do not envision this change in my lifetime.

Nevertheless, I want it.
