They all appear animated for me. I am missing the distinction, though.

Of the two in the body, the first one has 13 frames and is smoother than the 5 frame one on the right. Only the one on the right can be made a user icon, becuase it is less than 40K.

In the FAQ it says that only the first frame will be used for the userpic, but it seems that that isn't right, in this case. Although that's how it acted when I went to look at the FAQ to see if I was missing something...

The FAQ clearly says: "Note that only the first frame of an animated image will be used in your userpic." and when I uploaded it, it didn't animate. Now it does.

Maybe they changed it after user uproar. That could happen on LJ...

A userpic for the Scrapbooking service, is what they mean.

Yeah, I misread it. That applies to userpics generated from the scrapbook, apparently. Shows what I get for only reading the highlighted text of my search. :(

It wasn't animating when I uploaded it, though. Now it is. Sigh. I used to be able to read.
